This End User License Agreement ("EULA") is a legal agreement between you and Impact Zero Hub Pvt Ltd, a private limited company incorporated in India ("Licensor," "we," "us"), for the Zero Social mobile application and any updates or supplements to it (the "App").
By downloading, installing, or using the App, you agree to this EULA. If you do not agree, do not install or use the App. Use of the Zero Social service is also governed by our Terms of Service and Privacy Policy, which are incorporated by reference where they apply to in-app behavior and data.
Subject to your compliance with this EULA, we grant you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to install and use the App on devices that you own or control, solely for your personal, non-commercial use of Zero Social as intended by us.
This license does not allow you to use the App on any device you do not own or control, except as permitted by the applicable app store's rules (e.g. family sharing where offered).
You may not, and may not permit others to:
The App, including its design, features, branding, and underlying software, is owned by Licensor and its licensors and is protected by copyright, trademark, and other intellectual property laws. Except for the limited license above, no rights are granted to you.
Content you submit through the App remains yours, subject to the license you grant us in our Terms of Service to operate the service.
We may provide updates, patches, or new versions of the App. Updates may be installed automatically depending on your device settings. We may modify this EULA; we will post the updated EULA at this page and update the "Last updated" date. Material changes will be communicated as described in our Terms of Service. Continued use of the App after changes constitutes acceptance of the revised EULA.
This EULA is effective until terminated. Your rights terminate automatically if you fail to comply with this EULA. We may suspend or terminate your access to the App at any time, including for violations of this EULA or our Terms of Service.
Upon termination, you must cease all use of the App and uninstall it from your devices. Provisions that by their nature should survive (including ownership, disclaimers, and limitations of liability) will survive termination.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL LICENSOR BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM OR RELATED TO YOUR USE OF THE APP, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THIS EULA OR THE APP SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US FOR THE APP OR IN-APP PURCHASES IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS (US$100), IF NO SUCH PAYMENTS WERE MADE. SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS; IN THOSE CASES, OUR LIABILITY IS LIMITED TO THE FULLEST EXTENT PERMITTED BY LAW.
If you obtained the App through Apple Inc.'s App Store, you acknowledge that this EULA is between you and Impact Zero Hub Pvt Ltd only, not with Apple. Apple is not responsible for the App or its content. Apple has no obligation to furnish maintenance or support for the App. If the App fails to conform to any applicable warranty, you may notify Apple and Apple may refund the purchase price paid for the App to you; to the maximum extent permitted by law, Apple has no other warranty obligation regarding the App. Apple is not responsible for addressing any claims by you or third parties relating to the App or your use of it, including product liability claims, regulatory compliance failures, or consumer protection claims. In the event of any third-party claim that the App infringes intellectual property rights, Licensor, not Apple, will be responsible for investigation, defense, settlement, and discharge of such claims, as required by applicable law and app store terms.
If you obtained the App through another authorized store (e.g. Google Play), similar terms imposed by that store may apply in addition to this EULA.
This EULA is governed by the laws of India, without regard to conflict of law principles, except where mandatory local consumer laws provide otherwise. Disputes are subject to the dispute resolution approach described in our Terms of Service.
